A republic is not defined by who rules. It is defined by whether government remains reachable by those who are governed.
ACCIAIO
Deliberatio non est proprietas rei pvblicae. Non est ratio procedendi qva res pvblica vtitvr. Ipsa est res pvblica.
Deliberation is not a property of the republic, nor a procedure it uses. It is the republic.
Ex qvo seqvitvr dvos omnino modos esse qvibvs res pvblica destrvi possit, ne semel qvidem in eam telo emisso. Prior est aliqvid in ipsvm deliberandi spativm interponere. Alter est spativm ipsvm ad nihilvm redigere.
So there are exactly two ways to destroy a republic without a single shot: set something inside the space of deliberation, or shrink that space to nothing.
Attingibilitatem appellemvs.
Let us call it reachability.
Reachability
A process is reachable when the person it acts on can know what was decided, learn why, argue the other side to someone who can change it, and get an answer in time. Tap a condition to remove it.
The process still runs perfectly. It has only stopped answering to the people it acts on.
The speed clock
How many actions a process takes before a remedy can arrive.
A penalty six months late binds a body that acts once a year. Against a process acting a thousand times a second, the same delay is nearly sixteen billion actions.
COHIBITIO
Nexvs actionem permittens qvaestionem mvtavit. In ipso telo mechanismvm posvit qvi instrvctionem non permitteret nisi nota secreta adhibita qvam cvstodes non possidebant. Ex eo tempore recvsatio teli non erat regvla de manipvlo. Erat ipsivs teli proprietas.
The permissive action link changed the question. It placed in the weapon itself a mechanism that would not let it be armed without a code its keepers did not hold. From then on, the weapon’s refusal was not a rule about the crew. It was a property of the weapon.
Cohibitiones extrinsecvs definitae intrinsecvs exseqvendae.
Restraints defined from outside, carried out from within.
No two are enough.
CVSTODIA
Lex rem tvtam esse dicebat. Nihil in rervm natvra verba exseqvebatvr.
The law said the herd was protected. Nothing in the world carried out the words.
Romani intellexerant potestatem qvae reddi non potest non magistratvm sed possessionem esse. Inter cavsas rvinae haec facillime nominatvr: imperivm redire desiit.
The Romans understood that power which cannot be handed back is not an office but a possession. Of the causes of the fall, this is the easiest to name: command stopped coming back.
Proprietas possessionis lingva loqvitvr. Cvstodia obligationis lingva loqvitvr.
Property speaks the language of possession. Custody speaks the language of obligation.
Custody or property
Something is held in custody only when all four conditions stand. Take one away.
Onerata, alteri profvtvra, rationi reddenda, revocabilis.
Bound, for another, accountable, revocable: so vast power can be held without forcing anyone to trust the holder.
Tenens qvi finem ipse statvit dominvs est.
A holder who sets the purpose himself is an owner.
Vnam tolle, et ratio fit proprietas nomine elegantiore indvta.
Take one away, and the arrangement becomes property in a finer name.
Qvi rationem reddere non debet dominvs est cvm titvlo honorifico.
One who owes no account is an owner with an honorary title.
Qvem nemo removere potest dominvs est cvi meliores relationes pvblicae adsvnt.
One whom nobody can remove is an owner with better public relations.
DISCIPLINA
Dissensio enim reqvirit vt termini controversiae vtriqve idem significent. Qvod apvd Corcyram dispvtationi svccessit non fvit dispvtatio prava. Fvit factio, id qvod restat vbi dispvtatio impossibilis fit.
To disagree, both sides must mean the same thing by the words in dispute. What replaced argument at Corcyra was not bad argument. It was faction: what is left when argument becomes impossible.
Lingva non est descriptio institvtionvm. Est materia in qva institvtiones servantvr.
Language is not a description of institutions. It is the material in which institutions are kept.

Thucydides watched the words for virtues and vices change places in a single summer of civil war.
RESPVBLICA
Omne institvtvm proximis decenniis aedificatvm eidem qvaestioni respondebit, sive artifices norint sive non: qvid hominem esse credebant?
Every institution built in the coming decades will answer one question, whether its builders know it or not: what did they believe a human being to be?

Michigan’s automated fraud system decided a little over forty thousand cases by algorithm alone. Nothing in that system was technically advanced.

Stone confesses. Law confesses. Software confesses most of all.
The five safeguards
Each fails without the others. Touch a node; touch the centre for all five.
Systema statvm internvm possideat qvo agere recvsat; hvnc statvm asseqvi proprietas constrvctionis eivs sit, non regvla operatoribvs imposita.
Refusal. The system must have an inner state in which it declines to act, reached by its construction, not by a rule laid on its operators. A system that must always answer always will, and will dress the answer to look good.
Machina rei pvblicae mensvratvr longitvdine lineae inter civem et evm qvi qvod factvm est revocare potest.
Reachability. For every decision that touches a person there is a named human office, reachable in a published time, with power to undo it. The machine of a republic is measured by the length of the line between the citizen and the one who can undo what was done.
Facvltas pvblica amplitvdine exercita habita, non possessa, pvtanda est.
Custody. A capability used at public scale is held, not owned: its holder must act for the people, avoid conflicts, account when asked, and be removable for failure.
Institvtvm qvod se erravisse fateri non potest occvltabit.
Publication of failures. Failures are reported beside successes, in the same place, by the same party. An institution that cannot admit error will conceal it.
Res pvblica qvae svvm interiorem dissensvm videre non potest instrvmentvm amisit qvo mentem mvtat.
Dissent on the record. When parts of a system disagree, the conflict is kept with its reasons. A republic that cannot see its own dissent has lost the instrument by which it changes its mind.
Avt omnes vna exseqvimini, avt nvllam.
Refusal without reachability is a machine that stops and cannot be asked why; custody without publication is a trustee who answers to no one. All together, or none.
APPENDIX
Haec appendix exstat qvia charta qvam artifex machinarvm exseqvi non potest charta est qvae nvmqvam constrvetvr.
This appendix exists because a charter an engineer cannot implement is a charter that will never be built.
Recvsatio qvam is qvi fvnctionem vocat per errorem neglegere potest recvsatio non est, qvidqvid compilator existimet.
A refusal the caller can ignore by mistake is not a refusal, whatever the compiler thinks.
Vbi lector meliora novit, lector recte sentit.
Where the reader knows better, the reader is right.
DE NOMINE
Repvblicvs nomen fictvm fvit scriptoris Anti-Foederalistae in Actis Kentvckiensibvs vere anni MDCCLXXXVIII scribentis, et is qvi vehementissime contendit nihil inter popvlvm et exitvm svffragii interponendvm esse.
Republicus was the pen name of an Anti-Federalist writing in the Kentucky Gazette in the spring of 1788, the one who argued most fiercely that nothing should stand between the people and the outcome of their vote.

The pen name will be laid down if the argument is taken into use.
What would prove us wrong
Si institvta ordinaria eadem celeritate procedvnt.If ordinary institutions keep pace, reviewing and reversing machine decisions about as often as they are made.
Si regimen externvm per se svfficit.If outside oversight alone produces no worse harm than internal refusal.
Si anticipatio extrinsecvs reparari potest.If deterrence can be restored from outside, so operators act as if a real, personal sanction were likely.

It is a work, and it will still be unfinished when it passes to others. That is not a flaw in the work. That is the work.
